Niraj Kumar v. State Of Haryana And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 14345 of 2017 Date of decision : 06.07.2017 Niraj Kumar ....Petitioner V/s State of Haryana & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Vikas Bishnoi, Advocate for the petitioner. RAJAN GUPTA J.
Present petition has been filed by petitioner seeking a writ in the nature of certiorari for quashing impugned order dated 10.07.2015 passed by Permanent Lok Adalat, Fatehabad. It has been urged before the court that the order is unsustainable as it has been passed on incorrect factual basis. He submits that siphon is in fact in the land belonging to the petitioner. This fact has not been considered by the Lok Adalat. Besides, inquiry report submitted by the police is also in favour of the petitioner. It is evident that Lok Adalat passed the order after considering rival contentions of the parties. Pleas raised before this court are primarily factual in nature which cannot be decided in writ jurisdiction. Besides, there is nothing on record to show that decision given by the Lok Adalat suffers from any infirmity. Petition is, thus, without any merit and is hereby dismissed.
