The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction, particularly in the nature of Mandamus, directing the respondents to release and reimburse the medical expenses amounting to Rs. 2,02,292/- incurred by the petitioner towards his emergency cardiac treatment at Postgraduate Institute of Medical Education and Research along with
interest. Further praying for directing the respondents to release the payment of the aforesaid duly verified and approved medical claim, which was forwarded by respondent No. 2 to the competent authority vide Memo dated 19.09.2024 (Annexure P-4), but has not been released till date without any lawful justification, thereby rendering the action of the respondents arbitrary, unreasonable and violative of Articles 14 and 21 of the Constitution of India. 2.
Learned counsel for the petitioner submits that he would be satisfied if the representation, Annexure P-7, of the petitioner is decided by the respondents by passing a speaking order in a time bound manner. 3.
Mr. Prince Singh, Advocate, appearing on advanced notice, submits that he has no objection in case a direction is issued to the respondents for time-bound consideration and decision of the representation of the petitioner by passing a speaking order. 4.
Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.1 is directed to consider the representation, Annexure P-7, of the petitioner and pass a speaking order, after affording him an opportunity to be heard, within a period of 02 weeks from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, in the event the petitioner is found entitled to the relief claimed, he shall also be entitled to interest @ 6% per annum, to be calculated after the expiry of two
months from the date of submission of the medical bills, and the same shall be released forthwith by the respondents.
