KARAMJIT SINGH , J. (Oral) The case has been taken up through Video Conferencing due to prevailing situation of COVID-19.

The petitioner has filed this petition under Article 226 of the Constitution of India for issuance of a writ of mandamus for grant of his service benefits along with all consequential benefits admissible to him w.e.f 24.10.2011 as juniors to him have already been regularly promoted. Learned counsel for the petitioner states that for the relief, which has been claimed in the present writ petition, the petitioner has served the respondents with a legal notice dated 02.07.2020 (Annexure P-11), which is still pending consideration with the respondents and the petitioner will be satisfied at this stage, in case, a time bound direction is issued to the respondents to decide his legal notice by passing an appropriate speaking order.

Without commenting upon the merits of the case or about the entitlement of the petitioner for the relief, which has been claimed by him in the legal notice dated 02.07.2020 (Annexure P-11), the present writ petition is disposed of with a direction to the respondents to decide the legal notice dated VIRENDRA SINGH ADHIKARI 2020.10.

CWP-16854-2020 -202.07.2020 (Annexure P-11), within a period of two months from the date of receipt of the certified copy of this order. Opportunity of personal hearing be also given to the petitioner by the concerned authority before deciding the aforesaid legal notice.

Accordingly, this writ petition is disposed of without commenting upon the merits of the case.
