*** Ritu Bahri, J. (Oral) Petitioner is seeking issuance of direction to release his contributory provident fund, gratuity, leave enchashment, benefit of ACP and Education Allowance/Conveyance Allowance. Petitioner was appointed as Accountant on 10.10.1997 and retired on attaining the age of superannuation on 31.08.2020. The petitioner was suspended, vide order dated 07.09.2017 and he gave representation, which was referred to Indian Red Cross Society, Haryana State Branch and vide order dated 20.12.2017, it was directed that in compliance of the Hon'ble Governor and President, a fresh enquiry be conducted. Till the fresh enquiry is held, the F.I.R registered against the petitioner be withdrawn and he be reinstated and salary be paid of the suspension period. Learned counsel submits that till date no enquiry has been held and the petitioner was reinstated, vide order dated 08.05.2018 and retired on 31.08.2020. Without expressing any opinion on the merits of the case, the present petition stands disposed of by giving direction to respondent No. 2 to pass speaking order on demand notice dated 05.09.2020 (P-4) within a period of three months from the date of receipt of certified copy of this order and thereafter inform this Court. Further if the petitioner is held entitled to the retiral benefits, the same be released to him within one month.
