(ORAL) Learned counsel for the petitioner very fairly states that against the conviction, petitioner has already filed a CRA-S-3627-SB-2015 titled as 'Sampuran Singh Master Vs. State of Punjab', which is still pending consideration before this Court and therefore, till the decision of the said appeal, petitioner does not wish to press the prayer for the grant of pensionary benefits as raised in the present writ petition, with the liberty to raise the said plea in case the same subsists after the decision of the criminal appeal. Learned counsel for the petitioner further argues that before the order of dismissal was passed, petitioner was under suspension and during the period of suspension he was not given the enhanced NARESH KUMAR 2019.11.29 12:14 I attest to the accuracy and integrity of this document Chandigarh

CWP-17951-2016 -2subsistence allowance even after an expiry of six months and for the grant of the said relief, petitioner has already served upon the respondents a legal notice dated 21.06.2016 (Annexure P-2), which is still pending consideration with the respondents and he will be satisfied in case a time bound direction is issued to the respondents to decide the claim for the grant of the enhanced subsistence allowance after a period of six months as he was not responsible for any delay in deciding the criminal proceedings, which were pending, due to which he was suspended. Learned counsel for the respondents very fairly states that legal notice dated 21.06.2016 (Annexure P-2) will be decided within a period of three months from the date of receipt of certified copy of this order and the appropriate orders will be passed qua the claim of the petitioner for the enhanced subsistence allowance only, as requested by learned counsel for the petitioner.

Learned counsel for the petitioner states that petitioner does not press this writ petition any further keeping in view the statement of learned counsel for the respondents and the present petition be disposed of as such.

Ordered accordingly with the liberties to the parties as recorded above.
