**** Rajan Gupta, J. (Oral) Petitioner has impugned order dated 05.12.2016 passed by Sub Divisional Magistrate, Abohar, whereby transfer deed, executed in his favour, has been set aside. At the outset, learned counsel for the petitioner submits that he did not avail remedy of appeal. According to him, same is maintainable in view of judgment rendered in the case titled as 'Paramjit Kumar Saroya versus The Union of India and another, 2014 AIR (Punjab) 121'.

In view of above, petitioner submits that he may be allowed to withdraw this petition with liberty to avail alternative remedy in view of judgment rendered in 'Paramjit Kumar Saroya's case (supra)'. Dismissed as withdrawn with liberty as aforesaid.
