**** RITU BAHRI , J. (Oral) Petitioner joined the services of respondent-Bank as Manager by transfer on deputation and absorption from Housefed Haryana being top professionally qualified having post graduate degrees and diplomas.

The grievance of the petitioner before this Court that he be promoted to the post of Statistical Officer/Planning and Evaluation Officer/District Manager/Asstt. Secy and Dy. Secy being senior and most eligible officer. His further prayer is that respondent No. 4 has wrongly been promoted to the post of Statistical Officer and further to the post of Asstt Secy, Deputy Secy and Addl. Secy, vide impugned orders. A bare perusal of the impugned order dated 01.07.2015 shows that the appeal filed by the petitioner has been dismissed rightly

-2on the ground that as per Staff Service Rules of the Haryana State Coop Agriculture and Rural Development Bank Ltd, the petitioner does not possess the essential qualification required for promotion to the post of Statistical Officer which is B.A with Economics or B.Com and three years experience as Technical Assistant in this Bank. Petitioner and Respondent-Bank are governed by the above said Rules and with regard to the promotion, the Rule reads as under:- Statistical Officer (a) By Direct Recruitment M.A (Economics) M/Com M.Sc (Mathematics or Statistics) with 3 years experience in the same line (b) By Promotion B.A. With Economics or B. Com 3 years experience as Technical Assistant in this Bank.

Petitioner is working as Manager and his next promotion is to the post of Assistant Manager for which 7 years experience as Clerk/Jr. Scale Stenographer is required and further he can be promoted to the post of Field Officer cum Assistant Manager Since the petitioner does not have 3 years experience as Technical Assistant in this Bank, his claim for promotion to the post of Statistical Officer been rejected and further the post of Manager and Technical Assistant are different and have separate seniority list which cannot be equated for deciding the seniority among the petitioner and respondent No. 4.

-3No ground is made out for quashing the impugned order dated 01.07.2015, as it does not suffer from any infirmity or illegality. The writ petition is dismissed being devoid of any merit. 16.02.2016 (RITU BAHRI) G Arora JUDGE
