CM-4146 & 4147-CWP-2023 in/and CWP-16846-2022 -22023:PHHC:130638 Registry is directed to tag the same at an appropriate place. CWP-16846-2022 The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to UGC to extent relaxation of 5% at Bachelor's as well as Master's level as he is a differently abled person.

The UGC in its reply has confirmed that as per clause 3.4 of 2018 Regulations, a candidate suffering from disability as mentioned in the said paragraph, is entitled to relaxation of 5% marks. The petitioner in terms of interim order passed by this Court was allowed to participate in the selection process, however, he was not selected on account of low merit. Learned counsel for the petitioner submits that claim of the petitioner for the appointment to the post in question has rendered infructuous, however, petitioner in future may be considered in terms of clause 3.4 of 2018 Regulations.

The authorities are bound to consider claim of the petitioner in terms of 3.4 of 2018 regulations, if found eligible, against the post, if any, advertised by the respondents.

The petition stands disposed of.
