Prayer in this petition is for a direction to the respondents to grant the benefit of family pension to the petitioner. It is submitted that husband of the petitioner was appointed as 4th Class employee (Sweeper) as contingent paid staff on 15.09.1992, thereafter, his services were regularized as on 31.12.2016. Petitioner's husband, it is submitted, working continuously from the year 1992 till his regularization and thereafter, till his unfortunate demise on 19.06.2018. It is submitted that services of the petitioner's husband prior to his regularization have also to be considered for the purpose of family pension and other benefits. Reliance in this regard has been placed on the judgment passed by Division Bench of this Court in CWP No. 2371 of 2010 titled as " Harbans Lal versus The State of Punjab and Others". In this respect, representation dated 28.10.2021 (Annexure P-9) has also been submitted by the petitioner but to no avail.

At this stage, learned counsel for the petitioner restricts the prayer for a decision on representation dated 28.10.2021 (Annexure P-9), submitted by the petitioner, in a time bound manner. RIYA 2022.08.10 10:42 I attest to the accuracy and authenticity of this document

Keeping in view the limited prayer addressed, facts and circumstances of the case but without expressing any opinion on the merits thereof, this writ petition is disposed of with a direction to the competent authority, to decide representation dated 28.10.2021 (Annexure P-9) by passing a speaking order, within three months from the date of receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within two months thereafter.          LISA GILL
