JASWANT SINGH, J (ORAL) The petitioner is a Physically Handicap employee with 100% blindness as per Certificate (P.1). He is appointed as an Associate Professor (Music Vocal) and has impugned the order dated 16.8.2016 (P.4) whereby he was transferred from the Government College, Amritsar to Government College, Kapurthala.

In the light of the contention that the transfer was in violation of the Special Policy dated 05.9.2002, this Court on 01.09.2016 while issuing notice of motion had stayed the impugned transfer order (P.4).

At the time of hearing today, learned State counsel, on instructions from Sh. Bhupesh Gupta, Sr. Assistant, O/o DPI (Colleges), Punjab, submits that fresh order dated 05.10.2016 has

CWP No.18017 of 2016 (O&M) #2# been passed by the Government whereby earlier transfer order of the petitioner has been cancelled.

In view of the aforesaid stand, present petition is disposed of as infructuous. However, it is directed that the payment qua salary of the petitioner with effect from his date of transfer till the passing of the aforesaid order shall not be unnecessarily delayed.
