Petitioners have filed these petitions under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.19 dated 26.05.2019 under Sections 15 and 18 of the NDPS Act, registered at Police Station City, Kabirpur (Akhikalan), District Kapurthala.

CRM-M-30421-2019 and connected case -2counsel appeared and contested the petitions. I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. In the present case, 2 kgs. of poppy husk and 200 grams of opium was recovered from the co-accused. The petitioners were not apprehended on the spot.

Vide order dated 26.09.2019, interim bail was granted to petitioner-Manjodh Singh @ Manjot Singh and vide order dated 03.10.2019, interim bail was granted to petitioner-Javdev Singh and they were directed to join the investigation.

Learned State counsel, on instructions from ASI Karamjit Singh, states that the petitioners have joined the investigation. In view of the above, the present petitions are allowed. The order dated 26.09.2019 passed in CRM-M-30421-2019 and order dated 03.10.2019 passed in CRM-M-42458-2019, granting interim bail to the petitioners, are made absolute. However, the petitioners shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by conditions of Sections 438(2) Cr.P.C.
