*** HARSIMRAN SINGH SETHI , J. (ORAL) CM-16434-CWP-2016 Present application has been filed for taking up the main writ petition and for deciding the same in terms of CWP No.12447 of 2013 titled as 'Suresh Bhardwaj Vs. State of Haryana and others, decided on 17.05.2016 (Annexure P-8).

On the joint request of learned counsel for the parties, the main case is taken up for hearing.

CM stands allowed.

-2In the present writ petition, the claim of the petitioner is for the grant of the pay of the post of Executive Officer, on which he had actually discharged the duties on current duty charge keeping in view the order dated 05.11.2004 (Annexure P-3).

Learned counsel for the petitioner very fairly states that keeping in view the order dated 22.09.2017 (Annexure R-1), petitioner has been granted the benefit of the pay-scale of Executive Officer w.e.f. 08.01.2002 till he retired on 31.08.2007.

Learned counsel for the petitioner states that while granting the benefit of the arrears, petitioner has not been granted the interest on the said arrears and he is entitled for the same keeping in view the settled principles of law.

Learned counsel for the petitioner further states that a liberty be granted to the petitioner to file an appropriate representation to the respondents claiming the benefit of interest on the arrears, which were released to the petitioner in pursuance to the order dated 22.09.2017 (Annexure R-1).

Learned counsel for the respondents very fairly states that in case any representation is filed by the petitioner claiming the interest, the same will be examined keeping in view the facts and circumstances of this case coupled with the settled principles of law and appropriate order will be passed within a period of three months from the date of receipt of such representation, if any.

-3Learned counsel for the petitioner states that keeping in view the statement given by learned counsel for the respondents, petitioner does not want to press this writ petition any further and the same may be disposed of as having been not pressed.

Ordered accordingly.
