(Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 79, dated 09.08.2019, under Section 22 of the NDPS Act, 1985, registered at Police Station Kathgarh, District Saheed Bhagat Singh Nagar. Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the FIR in question and a recovery of 12 injections of Leegesic containing Buprenorphine of 2 ML each, planted upon him. Further, contends that the petitioner has been in custody since 09.08.2019 and there is no likelihood of the trial concluding in the near future.
Per contra, learned State counsel on instructions from ASI Pawan Kumar submits that out of the 10 prosecution witnesses cited, 02 prosecution witnesses have been examined, 03 prosecution witnesses given up and only 05 prosecution witnesses remain to be examined. In the facts and circumstances of the case, no ground is made out to extend the concession of regular bail to the petitioner. Dismissed.
