* * * * S.J. VAZIFDAR, C.J. (ORAL) The petitioner has challenged the respondents' refusal to extend the time for paying the amounts due by the petitioner in respect of a plot allotted to him in the year 2008.

The plot was allotted to the petitioner on 12.09.2008. The petitioner unfortunately lost his father and his mother on 13.12.2008 and 05.03.2009. Both his parents had suffered ill health for some time. The petitioner sought to deposit further amount of 15% on 15.12.2009 i.e. after a delay of over one year.

Had the matter ended there, we may have explored the possibility of the petitioner and the respondents coming to some understanding. We are unfortunately unable to do so in view of what transpired thereafter. The authorities concerned by an order dated 15.03.2010 refused to extend the time for paying the balance amount. To permit the petitioner to now avail the benefit of the allotment granted nine years ago would be unfair to other citizens as well as to the government. Even to permit the petitioner a preemptive right would be unfair to the other participants of the fresh auction/draw of lots that may be conducted.
