IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH Civil Writ Petition No. 18154 of 2016 Date of Decision: 2.9.2016 Sudarshan Kumar .....Petitioner Vs.

Gram Panchayat Dhana and others .....Respondents CORAM : HON'BLE MR. JUSTICE RAMESHWAR SINGH MALIK Present :

Mr. S.K. Tripathi, Advocate for the petitioner.

**** RAMESHWAR SINGH MALIK J. (ORAL) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached this Court, by way of instant writ petition under Article 226/227 of the Constitution of India, seeking a writ in the nature of Mandamus.

Heard learned counsel for the petitioner.

It is a matter of record that civil suit filed by the petitioner is pending before the learned court of competent jurisdiction. In such a situation, present writ petition would not be maintainable. It is so said because the petitioner would not be permitted to pursue his remedies simultaneously before this court as well as civil court. In view of the above, instant writ petition is dismissed as not maintainable, at this stage.
