This is second petition for grant of regular bail to the petitioner pending trial in a criminal case arising from FIR No. 61 dated 03.07.2019, registered under Section 21/27-A of the Narcotic Drugs & Psychotropic Substances Act, 1985, at Police Station Bhikhiwind, District Tarn Taran. As per the case of the prosecution, the petitioner, after throwing a bag containing 265 grams of heroin along with the currency notes amounting to ₹45,000/-, tried to run away, but apprehended near the Polytechnic College. The first petition (Criminal Misc. No. M-40095 of 2020) for grant of regular bail was dismissed on 27.11.2019. Learned counsel for the petitioner contends that the petitioner is in custody for 1 year and 4 months approximately and after the presentation of the challan, there has been no progress in the trial of the case. Criminal Misc. No. M- 33136 of 2020 For the last seven/eight months, the normal functioning of the Courts has been hampered due to the spread of COVID-19, however, now the District Courts have started reopening in phases. Keeping in view the fact that the recovery from the petitioner falls in the category of commercial quantity, no ground is made out to grant the concession of regular bail to the petitioner. However, the trial Court is directed to conclude the trial of the case within a period of nine months from the date of receipt of a certified copy of this order. With the observations made above, the present petition is disposed of.
