The petition has been filed seeking a writ of certiorari quashing the revised Pension Payment Order dated 13.2.2014, Annexure P-3, wherein the qualifying service of the petitioner for retiral benefits has been counted from the date of CPF deduction, i.e., 1.7.1976, and not from the date of joining, i.e. 2.7.1973. Further, direction has been sought to the respondents to issue fresh Pension Payment Order counting his qualifying service from 2.7.1973, and release of the consequential arrears alongwith interest.

Learned counsel for the petitioner submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioner will be satisfied in case the respondents are directed to decide his pending representation dated 8.11.2021, Annexure P-5, in a specified period.

In view thereof, without going into the merits of the case, the petition is disposed of with a direction to respondent no.2/Commissioner and Director General, School Education, Haryana, to consider and decide the pending representation of the petitioner dated 8.11.2021, by passing a speaking order thereupon in accordance with law within a period of three months from the date of receiving a certified copy of this order.
