The petitioner has filed this petition seeking his release for three weeks emergency parole in terms of Section3(1)(a) of the Haryana Good Conduct Prisoners, (Temporary Release) Act, 1988 in order to enable him to get proper treatment from Chaudhary Orthopedic & General Hospital, Sirsa.

The petitioner has been convicted under Section 21 of the Narcotic Drugs and Psychotropic Substances, Act and sentenced to undergo rigorous imprisonment for ten years. His appeal against the said conviction is pending before this Court. The petitioner was released on special parole in terms of the directions of the High Powered Committee due to Covid-19 Pandemic. He met with an accident and his right elbow was fractured in the accident. He took treatment from Chaudhary Orthopedic and General Hospital, Sirsa. A surgery was also conducted. The petitioner was directed to surrender before the jail authorities by 04.05.2021. The petitioner surrendered before the jail authority on 12.05.2021. Crl. Writ Petition No.8630 of 2021 -2conducted as advised by the doctors of Chaudhary Orthopedic and General Hospital, Sirsa. In this regard, brother of the petitioner has submitted an application Anexure P.4 seeking release of the petitioner on emergency parole in order to get his surgery conducted and take other medical treatment. No decision thereon has been taken. Without commenting anything on merits of the case, the present petition is disposed of with a direction to respondents No.2, 3, and 4 to take a decision on the application of the petitioner expeditiously preferably within a period of three weeks.
