The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of advertisement of May' 2023 (Annexure P-1) which respondent No. 1 has issued for engagement of service provider for retail outlet at BP2, Sector-2, Panchkula. 2.

Learned counsel for the petitioner inter alia contends that respondent No. 3 had wrongly been awarded contract of service provider for retail outlet at BP-2, Sector-2, Panchkula. Respondent No. 3 did not comply with eligibility criteria, thus, respondent No. 1 has wrongly awarded contract to respondent No. 3. 3.

Learned counsel for the petitioner after arguing for some time, confines his prayer to issuance of direction to respondent No. 1 PARAMJIT KAUR SAINI 2023.07.06 18:40 I attest to the accuracy and authenticity of this order/judgment

CWP No. 14110 of 2023 -2- 2023:PHHC:084868 to supply documents of respondent No. 3 qua her experience. 4.

Mr. Ashish Kapoor, Advocate for respondents No. 1 and 2, who on advance notice is present in Court, submits that petitioner has not applied pursuant to fresh advertisement. 5.

Mr. Brijesh, Advocate, filed Memo of Appearance on behalf respondent No. 3 and submitted that respondent No. 3 is ready and willing to supply documents of her experience to the petitioner. She has no objection, if respondents No.1 and 2 supply documents of her experience to petitioner.

Memo of Appearance is taken on record. Registry is directed to tag the same at an appropriate place. 6.

In view of statement of learned counsel for the respondent No.3, the respondents No.1 and 2 are directed to supply documents of experience of respondent No. 3 to the petitioner within three weeks from today.
