(ORAL) Instant writ petition under Articles 226/227 of the Constitution of India has been filed for quashing the orders and directions issued vide letters dated 04.04.2014 (Annexure P-5) and 28.03.2014 (Annexure P-6) and for staying the operation of the same being unreasonable, unfair and unjustified.
Heard.
Learned counsel for the State submits that vide letters dated 12.11.2013, 21.11.2013, 27.01.2014 and 28.03.2014 petitioner was requested to submit Forms I, J and M, which were required to be RAVINDER SINGH 2015.08.18 16:44 I attest to the accuracy and authenticity of this document
-2CWP No.19902 of 2014 submitted by it in the year 2007-08 for becoming eligible for reimbursement of bonus paid at the rate of ` 50+50 = 100 per quintal to the farmers. Since the petitioner did not submit these forms along with the list of farmers who were paid bonus by it, therefore, FCI had recovered the amount reimbursed to the petitioner and other rice millers from the account of Food and Supplies Department. Learned counsel for the State submits that now petitioner has submitted all the requisite Forms and no objection certificate has also been issued to the petitioner on 12.3.2015. As such this writ petition has been rendered infructuous. Learned counsel for the petitioner submits that even HAFED has released the entire payment after issuance of no objection certificate. Dismissed as infructuous.
