:

The short question, which is pressed before me, is whether the additional increments granted to the petitioner - a Hindi Teacher, on 09.06.2007, could be withdrawn after over five years, without any notice or opportunity of hearing.

Counsel for the State of Haryana admits that before the passing of the impugned order, ordering withdrawal of the additional increments granted to the petitioner, no notice or opportunity of hearing was granted. MONIKA 2015.11.19 13:57 I attest to the accuracy and authenticity of this document

C. W. P. No. 25575 of 2012 2 In view of the aforesaid admission, the impugned order dated 28.09.2012 (Annexure P-3), being in violation of principles of natural justice, has no legs to stand on and resultantly, the same is ordered to be set aside. However, the respondents are granted liberty to pass a fresh order, in accordance with law.
