The present writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to grant the salary and other service benefits to the petitioner for the period the petitioner performed duties as an Inspector in the respondent-Department under Current Duty Charge. 2.

Learned counsel for the petitioner at this stage submits that he would be satisfied if a direction is issued to the respondent No.2 to decide the representation dated 23.09.2024 (Annexure P-8) by passing a speaking

order in a time bound manner in light of the judgment rendered by this Court in CWP-3776-2021, Lakhwinder Singh Versus State of Punjab and others, decided on 12.05.2023 (Annexure P-5).

On advance notice, Ms. Pratibha Bali, Assistant Advocate General accepts notice on behalf of respondents-State, whereas, Mr. Nishant Maini, Advocate for Mr. Sarbuland Singh Mann, Advocate has put appearance on behalf of respondents No.3 and 4, filed memo of appearance and same is taken on record. They submit that they have no objection in case a direction is issued to the respondent No.2/competent authority to hear and decide the representation dated 23.09.2024 (Annexure P-8) by passing a speaking order in a time bound manner in terms of Lakhwinder Singh (supra).

In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and the respondent No.2/competent authority is directed to hear and decide the representation dated 23.09.2024 (Annexure P-8) by passing a speaking order in a time bound manner in terms of Lakhwinder Singh (supra), within a period of three months from the date of receiving a certified copy of this order. Further the decision taken thereof shall be conveyed to the petitioner.

Needless to say, if the petitioner is found entitled to the relief sought, the same be granted forthwith by respondent/competent authority.

Pending miscellaneous application(s), if any, shall also stands disposed of.
