The petitioner has filed this petition seeking grant of regular bail in a case registered against him vide FIR No.121, dated 10.8.2020, Police Station Odhan District Sirsa, under Section 22-B of NDPS Act. 2.
The allegations, in nutshell, are that the petitioner was found in possession of 200 tablets of 'Tramadol Hydrochloride' for which he could not produce any licence to justify his possession. MOHAN SINGH 2020.10.26 20:58 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner has submitted that he has falsely been implicated in the present case and that there is no independent evidence to corroborate the case of the prosecution. 4.
Opposing the petition, learned State counsel has submitted that since the petitioner was caught red-handed while in possession of 200 tablets of 'Tramadol Hydrochloride', no case for grant of bail is made out. The learned State counsel has however, not disputed that the total weight of the recovered contraband would fall in the category of 'non commercial quantity' being 81 grams in all and that the petitioner is not a previous offender and is not involved in any other case under NDPS Act.

I have considered rival submissions addressed before this Court. Keeping in view the fact that it is a case of recovery of 'non commercial quantity' of contraband and that petitioner is not wanted in any other case, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
