The prayer made in the present petition is for directing the respondent department to conduct re-counseling for the 5 vacant seats under the Majbi Sikh Sub Category under SC & ST Category.

Learned counsel submits that the petitioner applied for appointment for the post of Clerk pursuant to Advertisement, Annexure P-1, under the Scheduled Caste category, Sub Category of Majbi Sikh against 45 posts that were to be filled and 11 posts were for the said category. Final merit list was drawn on 09.01.2018, however under the Sports category one post of SC (Majbi Sikh and others category) and under the Ex-Serviceman quota three posts of SC (Majbi Sikh and other category) remained vacant. As per the Instructions dated 03.01.2017, Annexure P-8, in case any posts that remained vacant in the aforesaid categories, the same had to be filled amongst general pool of scheduled castes, in DINESH 2025.02.16 22:38 I attest to the accuracy and integrity of this document

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to have a relook at the matter and decided afresh within a period of 04 months, in terms of the Instructions referred to hereinabove, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner.
