This petition has been filed by the petitioner under Section 438 Code of Criminal Procedure for grant of anticipatory bail in case FIR No.387 dated 16.08.2018 under Sections 148, 149, 302, 323, 427, 452, 506 and 120-B IPC, registered at Police Station Kundli, District Sonepat. The petitioner apprehended his arrest at the hands of Police, in the above FIR. According to the prosecution case, petitioner along with other accused were involved in the occurrence, wherein brother of the complainant namely Gourav was assaulted with 'lathis' and 'dandas', who and died in the occurrence.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR and has been falsely implicated. According to Sheetal Gawri 2019.08.02 13:37 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-29251-2019 (O & M) -2him, petitioner was indicted on the basis of disclosure statement suffered by Manish, the main accused.

On the other hand, learned State counsel assisted by SI Lehna Singh has opposed the bail application on the ground that the offence is serious and custodial interrogation of the petitioner would be required. According to him, petitioner had participated in the crime and he along with Manish had inflicted injuries upon the victim. Considering the nature of the offence, this Court does not find any ground to extend the extra ordinary concession of anticipatory bail to the petitioner.

Dismissed.
