(ORAL) Having suffered concurrent adverse findings by both the Courts below, appellant/plaintiff is in second appeal before this Court assailing learned trial Court judgment and decree dated 09.08.2004, as upheld by learned First Appellate Court vide its judgment and decree dated 21.04.2006, whereby plaintiff's suit for rendition of account and mandatory injunction against defendants was dismissed. 2.

Matter was taken up for hearing on 20.02.2023, when none appeared for the parties. Registry was asked to issue fresh notice to learned counsel for the parties. Needful has been done. Office report reveals that counsel for appellant Sh. Navin Bawa, Advocate has been informed through e-mail while letter issued to counsel for the respondents, Sh. Rajesh Lamba, Advocate, has been received back duly served. Today, none appears on behalf of the parties. 3.

Be that as it may, dismissed in default.
