Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Angrez Singh Saini in Criminal Appeal No. 13 dated 04.01.2018 titled as "Angrez Singh Saini v. Arvinder Pal Singh" on the basis of complaint under Section 138 of the Negotiable Instruments Act, 1881.
Learned counsel for the petitioner contended that petitioner had no knowledge that on 10.05.2019, the case was transferred to the Court of learned Additional Sessions Judge, Chandigarh and when he came to know about the same, an application was filed before the learned lower Appellate Court for seeking exemption from his personal appearance, which was dismissed. Learned counsel for the petitioner further contended that petitioner has been regularly appearing before the Court and had no intention not to appear before the Court on the above noted date, but his warrants of arrest were issued under the above circumstances. Criminal Misc. No. M-29431 of 2019 As the matter in controversy to this point is only that bail of the petitioner has been cancelled whose case was received by transfer in the Court of learned Additional Sessions Judge, Chandigarh and even his application for seeking exemption from his personal appearance was dismissed, present petition stands disposed of with the directions that in case petitioner surrenders before the learned lower Appellate Court within a period of one week from today and moves an application for fresh bail, he shall be admitted to bail on his furnishing fresh bail and surety bonds.
