Reply to the petition, has been filed by the State, which is taken on record.

The learned State counsel, on instructions given to him by ASI Harbans Singh, submits, that after completion of investigations into the petition FIR, the investigating officer concerned, has filed an affirmative report under Section 173 Cr.P.C., before the learned Magistrate concerned, and, also with his making a further statement, that subsequently, a charge in respect of the petition offences became drawn against the petitioner, besides that thereafters the prosecution evidence also opening against the present petitioner.

Therefore, the learned counsel for the petitioner submits that he does not want to press the instant petition, for this Court making a mandamus, upon, the respondents concerned, to transfer the investigation into the petition FIR to an agency other than the one, which is holding investigations thereinto, and, that the petition may be disposed of as such. 4.
Accordingly, the petition is disposed of.
