On the instructions from ASI- Jai Kumar, learned State counsel states that FSL report has been received whereas in status report it has been wrongly mentioned as not received. However, he does not dispute the fact regarding the custody period of the petitioner and the recovery effected from the petitioner is of non-commercial in nature. He further states that challan has been presented and charges are yet to be framed. I have heard the learned counsel for the parties. The petitioner has been in custody since 01.06.2020 and charges are yet to be framed, the trial will take time to conclude and no useful purpose would be served by keeping the petitioner behind the bars. ,
