******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.03 dated 31.07.2017 registered for offences punishable under Sections 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 and 14 of Foreigners Act (added later on) at Police Station STF, Phase 4, SAS Nagar Mohali.

On asking of the court, Mr. Avtar Singh Sandhu, Addl. AG, Punjab., who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him. Learned State counsel on instructions from ASI Narinder Singh submits that the prosecution has concluded its evidence and the case is now fixed for 01.08.2019 for defence evidence. The petitioner is resident of Nigeria and is not having even valid passport and Visa for stay in India.
