Admittedly, the petitioners herein have filed a suit for grant of decree of declaration to the effect that they are entitled to the amount of compensation of the land which has been acquired by the Haryana Government under the National Highways Act, 1956 (hereinafter referred to as "the 1956 Act").

Now, the petitioners pray for direction to the competent authority, Land Acquisition-cum-Sub Divisional Judicial Magistrate, Ludhiana, to refer the matter to the Court under Section 3H(4) of the 1956 Act. The reference to the Civil Court is made in order to get final opinion upon the entitlement of the respective parties to the compensation or apportionment thereof. Once, the petitioners have already filed a suit in which the private respondents as well as the Union of India, National Highways Authority of India and the competent authority are the parties, a further direction to refer the matter to the Civil Court shall result in DEEPAK KUMAR BHARDWAJ 2022.09.01 10:24 I attest to the accuracy and integrity of this document
