-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for issuance of writ in the nature of habeas corpus under Article 226 of the Constitution of India directing the official respondents to release the detenue, who is none other than the daughter of the petitioners herein.
Notice of motion had been issued in the said matter, pursuant to which a status report by way of affidavit of Harsimrat Singh (PPS), Assistant Commisisoner of Police, Central Jalandhar on behalf of respondents No.1 & 3 has been filed.
As per the affidavit filed, the detenue Priya Rani, aged 18 years, is stated to have solemnized marriage with respondent No.4 on her own free will and as she was apprehending threat from the petitioners, the young couple approached the High Court by way of filing CRWP No.6487 of 2020, which petition was allowed.
As per the reply filed, the alleged detenue had solemnized marriage with respondent No.4 on her own free will and has categorically PANKAJ KUMAR 2021.02.25 15:23 I attest to the accuracy and integrity of this document
CRWP No.8332 of 2020 (O&M) -2stated that she is a major and knows about her well being. Taking the statement of the detenue into account that being major, she had solemnized marriage on her own free will, this Court finds no ground to issue a writ in the nature of habeas corpus. Consequently, the instant petition stands dismissed being devoid of merit.
