(ORAL) Counsel for the petitioner argues that petitioner had continuously served the respondent-department from 01.07.2007 till 30.06.2008, but the benefit of the said service i.e. increment has not been granted to her on the ground that the increment was to be given on 01.07.2008 on which date she had already retired and therefore, the benefit of increment cannot be given.
Counsel for the petitioner further argues that the respondentdepartment has already issued the instructions dated 03.04.2019 (Annexure P-5) allowing the said benefit to those who have retired on 30th of June, but the benefit of the same is not being extended to the petitioner without any valid justification.
Counsel for the petitioner submits that for the relief which has been sought in the present writ petition, petitioner has served the respondents with a legal notice dated 12.04.2019 (Annexure P-6), which NARESH KUMAR 2019.07.18 16:56 I attest to the accuracy and integrity of this document Chandigarh
CWP-19073-2019 -2is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 12.04.2019 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months.
Present writ petition stands disposed of.
