Prayer in this petition filed under Section 482 CrPC is for quashing of FIR No.145 dated 18.2.2020 under Sections 307, 323, 324, 34 & 506 IPC registered at Police Station Sadar Bhiwani, District Bhiwani. Learned counsel for respondent no.2-complainant has objected to the present petition on two grounds, firstly, that charges have been framed in the matter and the order of framing of charges, which is a judicial order, has not been challenged and secondly, majority of the witnesses have been examined and the trial is going on in a fast speed.

At this stage, State counsel submits that only three witnesses remain to be examined and once charges have been framed, then the judicial order would eclipse and consequently, the present petition for quashing of the FIR in question is not maintainable.

I am in agreement with the submission made by the State counsel as well as respondent no.2.

Accordingly, the present petition is disposed of, as not ASHWANI KUMAR 2022.11.01 10:35 I attest to the accuracy and authenticity of this order/judgment
