CWP No. 19498 of 2015
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CWP No. 19498 of 2015 DATE OF DECISION :- September 15, 2015 Ram Phal
...Petitioner
Versus
Union of India and others
...Respondents
CORAM:
HON'BLE MR.JUSTICE M.JEYAPAUL HON'BLE MR. JUSTICE DARSHAN SINGH Present:- Mr. D.R. Sharma, Advocate for the petitioner. *** M.JEYAPAUL, J.
1.
Heard the submissions made by learned counsel appearing for the petitioner.
2.
The grievance of the petitioner is that his junior had become Senior Goods Clerk prior to him as he was spared to join the said post, whereas the petitioner was not so spared in 1986. 3.
The cause of action for the present challenge made by the petitioner had arisen during the year 1986-87. Unfortunately, the petitioner having slept over for about 21⁄2 decades, moved Original Application before the learned Tribunal, aggrieved by the alleged unfair treatment meted out to him. Even after the representation
CWP No. 19498 of 2015 made by the petitioner was dismissed, he took about three years to approach the learned Administrative Tribunal to redress his grievance.
4.
It is a well settled position of law that law of limitation will have to be applied with all its rigors and the Courts shall not come to the aid of those who slumber over their rights, unmindful of the period of limitation provided under law.
5.
As the case of the petitioner is hopelessly barred by limitation, we find that there is no merit in the petition. Therefore, the Writ Petition stands dismissed.
