Prayer in the present petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is for setting aside the order dated 05.04.2025 (Annexure P-5) passed by learned Additional District and Sessions Judge, Sri Muktsar Sahib in FIR No.189 dated 26.10.2023 (Annexure P-1) under Section 21(b) of NDPS Act, 1985 Act registered at Police Station City Malout, District Sri Muktsar Sahib whereby bail bonds of the petitioner were cancelled and his surety bonds were forefeited. 2.

Learned counsel for the petitioner contends that on 05.04.2025, the petitioner is stated to have been admitted in De-Addiction Centre and therefore, he could not appear before the trial Court on the said date. 3.

Learned counsel for the State has informed this Court that the petitioner is involved in another FIR bearing No.93 dated 21.02.2024 under the NDPS Act, 1985. Therefore, the petitioner has misused the concession of bail by indulging in another case under the NDPS Act, 1985. 4.

In view of the above facts and circumstances, no ground is made out to interfere in the impugned order dated 05.04.2025 and the present petition Sonia Puri 2025.05.26 18:26 I attest to the accuracy and integrity of this document

CRM-M No.28820 of 2025 -2is hereby, dismissed. 5.

However, the petitioner is directed to appear and surrender before the trial Court concerned within a period of 07 days from today and may file bail application before the concerned Court. In case, he does so, the same be considered by the trial Court concerned, in accordance with law, within a period of 03 days thereafter.
