(ORAL) This petition has been filed by the petitioners praying for a writ of mandamus directing the respondent-Corporation to merely clarify their exact requirement with respect to nature of tank trucks i.e. top loading tank trucks or bottom loading tank trucks in relation to the Notice Inviting Tender (NIT) dated 22.10.2020 (Annexure P-1).

Learned counsel for the petitioners submits that post filing the writ petition, they have received a show cause notice dated 09.09.2021 from the respondent-authorities. He further submits that the petitioners have filed reply to the show cause notice on 10.09.2021 and the matter is pending before the respondent-authorities which are yet to take a decision in this regard. In the circumstances, the petition filed by the petitioners is premature as no decision has been taken by the respondent-authorities. The petitioners are free to take up all the issues before the respondent-authorities and, therefore, at this stage, we find no reason to entertain the present petition which is dismissed as premature.
