(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that though he retired from service on attaining the age of superannuation on 30.09.2018, but the pensionary benefits, for which he was entitled were not released immediately/within a reasonable time and were delayed by the respondents without any valid justification and therefore, keeping in view the settled principle of law as settled by the Full Bench of this Court in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468, the petitioner is entitled for the interest on the delayed payments.

CWP-19167-2019 -2respondents with a legal notice on 11.02.2019 (Annexure P-1), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 11.02.2019 (Annexure P-1) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
