Substantially the same issue has been decided by this Court in CWP No.3569 of 2011 on October 29, 2014 where six writ petitions filed by BSNL, decided by the common order, have been dismissed. Mr. Sharma fairly points out that when notice of motion was issued in this case on April 07, 2011 the present petition was ordered to be heard with CWP No.3569 of 2011 and, therefore, he could make no further submissions in the present case as the controversy has been settled against the BSNL.
