By way of this petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the petitioners seek quashing of FIR No.270 dated 24.09.2023 under Sections 295-A, 452, 323, 506, 34 IPC (Section 295A deleted later on vide DDR No.19 dated 23.11.2024 and Section 295 added later on) registered at Police Station Civil Lines Batala, Police District Batala alongwith all consequential proceedings arising therefrom on the basis of compromise dated 28.04.2025 (Annexure P-2).

Affidavit of respondent No.2 in support of compromise arrived at between the parties, has been filed in Court today and the same is taken on record.

Mr. Nishant Sehgal, Advocate has put in appearance and has filed Power of Attorney on behalf of respondent No.2 in Court today and confirms the factum of the compromise having been effected between the parties and states that respondent No.2 has no objection to the quashing of FIR in question. 6.

Learned State counsel has stated no objection in case the FIR is quashed based upon the compromise. He further states that the petitioners are not involved in any other case.

I have heard learned counsel for the parties and perused the material placed on record.

In view of the above, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences, therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 9.

Accordingly, the petition is allowed and FIR No.270 dated 24.09.2023 under Sections 295-A, 452, 323, 506, 34 IPC (Section 295A deleted later on and Section 295 added later on) registered at Police Station Civil Lines Batala, Police District Batala alongwith all consequential proceedings arising therefrom, are quashed qua the petitioners.

Needless to say that the parties shall remain bound by the terms of compromise.
