The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking setting aside of order dated 29.07.2026 passed by Ld. Permanent Lok Adalat, S.B.S. Nagar (for short 'PLA') whereby it has directed to refund amount of Rs.10,00,000/- along with interest @9% p.a.

Learned counsel for the petitioners submits that PLA has passed impugned order without complying with mandate of Section 22C(7) of Legal Services Authorities Act, 1987 read with judgment of Hon'ble Supreme Court in Canara Bank v. G.S. Jayarama, Law Finder Doc Id # 1989194.

Learned Senior Counsel for the respondent No.1 expressed his inability to controvert applicability of aforesaid judgment to the instant case.

In the wake of statement of both sides and keeping in mind Canara Bank (supra), the petition is hereby allowed and impugned order is set aside. The matter is remanded to PLA to pass fresh order keeping in mind Canara Bank (supra). PLA is requested to expedite the matter in view of the fact that impugned order was passed on 29.07.2016. The parties at the first instance would appear before the PLA, S.B.S. Nagar on 16.04.2026 and thereafter as fixed by aforesaid Court. 5.
