G.S.SANDHAWALIA, J. (Oral) The petitioners seek the benefit of second and third ACP with all the consequential benefits which is due since 2006. The relief is claimed on the strength of the judgment passed in CWP No. 10051 of 2013, Prithvi Singh vs. State of Haryana and others decided on 27.04.2016 (Annexure P-4) and in CWP No. 23074 of 2010, Ram Pal Patwari and others vs. State of Haryana and another decided on 24.07.2015 (Annexure P-5). Counsel for the petitioners has submitted that the first ACP was granted in the year 1996 and the second and third are due in 2006 and 2016 but have not been granted. Counsel further submits that legal notice dated 19.05.2017 (Annexure P-3) has already been served upon the respondents regarding the said aspect but the same has not been decided. Counsel further submits that he would be satisfied if a direction is issued to the respondents to decide the said legal notice within a fixed time frame. Notice of motion.

Without commenting on the merits of the case or the entitlement of the petitioners for the abovesaid relief and keeping in view the fact that the matter is still pending consideration, the present writ petition is disposed of with direction to respondent no. 3 to take a decision on the said legal notice dated 19.05.2017 (Annexure P-3) within a period of 3 months from the date of receipt of certified copy of the order. In case the petitioners are found entitled for the said benefit, the same be granted to them expeditiously. Needless to say if the benefit is to be declined, a reasoned order be passed and the same be conveyed to the petitioners. 21.07.2017 (G.S.
