Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner seeks the concession of prearrest bail, in case DDR No.35 dated 12.04.2024, under Sections 323, 324, 326, 34 of the IPC, registered at P.S. Gate Hakima, Amritsar, in FIR No.17 dated 30.01.2024, under Sections 364, 323, 324, 148, 149 of the IPC, registered at P.S. Gate Hakima, Amritsar.

The learned counsel for the petitioner relies upon an order dated 22.05.2024, as drawn by this Court upon CRM-M-262122024, to contend that, since the petitioner's co-accused Kanish has already been granted interim bail, therefore, the petitioner being on a co-equal pedestal as his co-accused (supra) also deserves an alike relief.

In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C.
