The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed seeking directions for proper investigation in FIR No. 67 dated 9.7.2020, under Sections 452/324/323/148/149 IPC (326 IPC added later on), registered at Police Station, Behrampur, District Gurdaspur.

From the pleadings, it is apparent that there is a version and cross-version of the incident alleged to have occurred on 29.6.2020. The petitioner lodged the FIR, whereas DDR No. 28 dated 15.7.2020 was registered by the other party. The allegations are that both the parties had suffered injuries.

named in the FIR are not being arrested by the police. Learned counsel for the State appearing on advance notice submits that the matter is still under investigation. The FIR is of July, 2020 and as per the statement of learned counsel for the State, the matter is still being investigated into. At this stage if the directions sought for in the present petition for arrest of the accused are issued, it would have impact on the investigation. There is no doubt that the police officials will investigate the matter fairly, in accordance with law as expeditiously as possible and necessary steps in furtherance with the investigation would be taken as and when required. The present petition is dismissed.
