3. Whether the judgment should be reported in the Digest? --- Surya Kant, J. (Oral) The petitioner is proprietor of village Naultha, Tehsil and District Panipat. He seeks a mandamus to direct the Deputy Commissioner, Panipat to take appropriate decision pursuant to the resolution dated 26.07.2012 (Annexure P-3) passed by the Gram Panchayat of his village. He also seeks a decision on the application dated 28.08.2012 (Annexure P-4) in which the above-mentioned relief has been sought. The controversy pertains to identification of the site for carving out 100 square yard plots to be allotted to the persons living below poverty line, as per the State Government Policy. It appears that the Gram Panchayat earlier decided to carve out the plots on the land which actually belongs to shamlat thola panna.
On the protest being raised by the proprietors of the village, the Gram Panchayat passed the above-stated resolution which is still awaiting approval/final decision by the Deputy Commissioner, Panipat. It is stated that MOHINDER KUMAR 2015.02.
CWP No.1958 of 2015 [2] another resolution has also been passed by the Gram Panchayat later on.
In the light of the above-facts and the nature of relief sought in this writ petition, we do not express any views on merits at this stage. Suffice it would be to dispose of this writ petition with a direction to the Deputy Commissioner, Panipat to take appropriate decision in accordance with law/Government Policy, on the resolution passed by the Gram Panchayat, within a period of four months from the date of receiving a certified copy of this order.
