The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of notice dated 15.05.2018 (Annexure P-10) for cancellation of LOI of the petitioner. 2.
Learned counsel for the petitioner, at the outset, submits that he does not press this petition qua LOI because Government Agencies have refused to issue NOC and he confines his prayer to issuance of direction to respondent No. 2 to release the amount of security which the petitioners have deposited at the time of execution of agreement. The petitioners have deposited security of Rs. 06 lakh with respondent No. 2 and respondent No. 2 in its reply has admitted this fact. Respondent No. 2 is not disputing its liability of aforesaid amount which respondent No. 2 has received as security.

Respondent No. 2 is directed to refund the aforesaid amount to the petitioner within two months from today.
