Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.243 dated 20.05.2023 under Sections 406, 420 and 506 of the IPC and Section 24 of the Immigration Act, 1983, registered at Police Station Gannaur, District Sonipat.

On the last date of hearing i.e. on 17.05.2024, this Court had granted the concession of interim bail to the petitioner and asked her to join investigation.

Learned counsel for the petitioner submits that in compliance of order dated 17.05.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from SI Satish Kumar, has not disputed the factum of the petitioner having joined investigation and cooperated with the investigating agency. CRM-M-32568-2023 -2submitted that the recovery of the money which was handed over to the petitioner by the complainant has not been recovered. 5.

Be that as it may, since the petitioner has joined investigation and cooperated with the investigating agency, merely non-recovery of the entire money which was allegedly handed over to the petitioner by the complainant, cannot be a ground for denying the bail to the petitioner moreso when she has no other criminal antecedents. 6.

In view of the above, the petition is allowed and interim order dated 17.05.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
