Criminal Misc. Application bearing No. CRM-45252-2025, under Section 528 of BNSS, 2023, has been filed seeking withdrawal of the main case i.e. CRM-M-28872-2025, which is listed for 18.12.2025. 2.

In the main case, on 29.07.2025, following order was passed:- "

At the outset, learned State counsel has filed the custody certificate dated 28.07.2025 in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place. A copy thereof has been handed over to the counsel for the petitioner.

Though investigation is complete, but charges are yet to be framed. Let the complainant be examined at the first instance. List again on 18.12.2025."

Today, on the very outset, learned counsel for the applicantpetitioner submits that applicant-petitioner prays for withdrawal of main petition, as the applicant-petitioner does not wish to pursue the aforesaid main petition any further. Therefore, there is a request of learned counsel for the applicant-appellant that the date of hearing in the main case, which is fixed for 18.12.2025 be also pre-poned for today itself, and then applicantJAWALA RAM 2025.11.21 10:56 I attest to the accuracy and authenticity of this document

Mr. Kanwar Sanjiv Kumar, AAG, Haryana, who is present in Court, accepts notice on behalf of the non-applicant/respondent - State and pleads no objection to the prayer made therein. 6.

In view of the prayer and the averments made in the application, date of hearing in the main case is pre-poned from 18.12.2025 to today itself i.e. 20.11.2025, and same is taken on board for its disposal. 7.
