Parvari Devi v. State Of Punjab And ORS.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 19637 of 2015 Date of decision: 16.09.2015 Parvari Devi ....Petitioner(s)
Versus
State of Punjab and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Ravi Gakhar, Advocate, for the petitioner.
G.S.SANDHAWALIA, J. (Oral) The petitioner seeks relief of regularization on the post of a Safai Sewika on the ground that she has been rendering services since 01.02.1994.
It is the case of the petitioner that she has been working on part time basis initially for two hours and thereafter for four hours with the Children Home, Patiala. It is the case of the petitioner that similarly situated employees have been regularized. The petitioner has made several requests dated 14.07.2015 (Annexure P-6) and 27.07.2015 (Annexure P-7) to respondent no. 2. A legal notice dated 24.08.2015 (Annexure P-8) has also been served upon the said respondent asking for the said relief but no action has been taken on the same.
Counsel submits that he would be satisfied if a direction is issued to the respondents to take a decision on the said legal notice within a time bound frame.
Accordingly, keeping in view the limited relief sought and without going into the merits of the case, this Court does not feel necessary to call upon the respondents to file reply.
Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration legal notice dated 24.08.2015 (Annexure P-8) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 16.09.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.09.16 15:00 I attest to the accuracy and integrity of this document Chandigarh
