G.S.SANDHAWALIA, J. (Oral) The petitioner seeks setting aside of the order dated 17.04.2015 (Annexure P-1) whereby, respondent no. 5 asked him to deposit the sum of `9,30,000/- on account of the fact that he, while working as an Accounts Clerk, has misappropriated the same. A condition was put that in case he did not deposit the money within 15 days, an FIR would be lodged against him.

Admittedly, the FIR has been lodged. Nothing has been placed on record that whether any proceedings had been initiated for recovery of the said amount in any manner.

In such circumstances, the present petition is premature and is dismissed as such. It is always open to the petitioner to challenge any recovery proceedings, if initiated subsequently, by taking recourse to law. 06.11.2015 (G.S.
